2. Definitions

Provider - FastGento, a provider of online store development services based on Adobe Commerce / Magento 2 platform.
Client - any natural or legal person who uses FastGento's services.
Services - the development, customization, maintenance and optimization of online stores on the Magento 2 platform.

3. Services Offered

FastGento provides ecommerce development services on the Magento 2 / Adobe Commerce platform, including but not limited to: creating online stores, theme and module customization, integrations with external systems (ERP, CRM, payment processors, couriers), performance optimization, migrations from other platforms, and ongoing technical support.

4. Service Contracting

Services are provided based on an individual contract or an order accepted by both parties. Prices, delivery deadlines, and technical specifications are established in the individual contract or in the commercial offer accepted by the Client.

5. Provider Obligations

FastGento undertakes to provide services with professionalism and diligence, to meet the deadlines established in the contract, to ensure the confidentiality of the Client's information, and to provide technical support according to the agreed conditions.

6. Client Obligations

The Client undertakes to provide all information and materials necessary for the provision of services, to make payments on the established deadlines, to respect the Provider's intellectual property rights, and not to use the services for illegal purposes.

7. Intellectual Property

Custom source code developed specifically for the Client becomes their property after full payment for the services. FastGento's pre-existing modules, libraries, and components remain the Provider's property, with the Client receiving an unlimited usage license. The content of the fastgento.ro website (texts, images, design) is protected by copyright and may not be reproduced without FastGento's written consent.

8. Limitation of Liability

FastGento is not liable for indirect losses, loss of profits, or consequential damages. The Provider's total liability is limited to the value of the contracted services. FastGento does not guarantee specific business results (sales, conversions, traffic) as these depend on numerous external factors.

9. Force Majeure

Neither party shall be liable for non-fulfillment of obligations in the event of force majeure, such as natural disasters, wars, pandemics, government restrictions, or major telecommunications infrastructure failures.

10. Dispute Resolution

Any dispute arising from or in connection with these Terms & Conditions shall be resolved amicably. If the parties cannot reach an agreement, the dispute shall be settled by the competent courts in Cluj-Napoca, Romania.

11. Amendments

FastGento reserves the right to modify these Terms & Conditions at any time. Changes take effect upon publication on the website. Continued use of the website after publication constitutes acceptance of the new terms.
